Terms of Service

1. Introduction

These Terms of Service govern your use of DocuMarkdown, operated by DocuMarkdown ("we", "us", or "our"). By accessing or using our service, you agree to be bound by these terms.

2. Acceptance of Terms

By creating an account, accessing, or using DocuMarkdown, you confirm that you are at least 18 years old and have the legal capacity to enter into these terms. If you are using the service on behalf of an organisation, you confirm that you have authority to bind that organisation.

3. Description of Service

DocuMarkdown is a document conversion service that allows users to upload various file formats (PDFs, Word documents, PowerPoints, spreadsheets, HTML, and more) and convert them into structured Markdown. We do not guarantee that every file will convert perfectly, as output quality depends on the source file formatting.

4. Acceptable Use

You must not misuse the service. This includes, but is not limited to:

• Using the service for any unlawful purpose or to promote illegal activities
• Uploading content that infringes intellectual property rights
• Attempting to gain unauthorised access to our systems or other users accounts
• Using automated tools to scrape, probe, or overload our infrastructure
• Uploading malware, viruses, or other harmful content
• Reverse engineering or attempting to extract our source code

5. Account and Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep this information up to date.

6. Payment and Subscriptions

Payments are processed by Stripe. Stripe handles billing, tax calculation and collection, and payment processing on our behalf. For payment, billing, cancellation, and refund mechanics, please refer to Stripe's Consumer Terms.

7. Intellectual Property

All intellectual property rights in the service, including software, documentation, branding, and content (excluding user-uploaded files), are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable right to use the service within the scope of your selected plan.

You retain ownership of any content you upload. By uploading content, you grant us a limited license to process it solely for the purpose of providing the conversion service.

8. Service Level and Warranties

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability shall be limited to the total fees paid by you in the six (6) months preceding the claim. We shall not be liable for any indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. This does not apply to liability for fraud, death, or personal injury where required by law.

10. Suspension and Termination

We may suspend or terminate your access if you materially breach these terms, fail to pay applicable fees, pose a security or fraud risk, or repeatedly violate our acceptable use policy. Upon termination, your right to use the service ceases immediately.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by email or through the service. Continued use after changes constitutes acceptance.
